Terms of Trade
TEST TAG & REPAIR – TERMS OF TRADE (New Zealand)
Effective 1 August 2025
1. Definitions
“We / Us / Our” means Test Tag and Repair (“TTR”).
“You / Your” means the person or entity requesting our services.
“Appliance” means any electrical or electronic item delivered to us for inspection, testing, repair, or servicing.
2. Quotes & Authorisation
2.1 Quotes are estimates, not fixed prices, unless stated otherwise in writing.
2.2 Your delivery of an Appliance to us, or your written / verbal “go-ahead”, is acceptance of these Terms.
2.3 If, during repair, we uncover additional faults or safety issues, we will seek your approval before proceeding, unless immediate action is required for safety.
3. Payment
3.1 Due on receipt – invoices are payable immediately unless we agree otherwise in writing.
3.2 Late payments may attract:
• Interest at 2 % per month (or the maximum allowed by law), and
• All reasonable costs of debt recovery (including collection agency and legal fees).
3.3 Call-out fee: $35 includes the first 20 minutes; thereafter $60 per hour, billed in 10-minute increments.
3.4 Recycling / disposal fee: Up to $20 per Appliance if you decline a repair.
4. Risk, Ownership & Abandonment
4.1 Risk in the Appliance remains with you at all times. You are responsible for insuring it.
4.2 We retain a repairer’s lien—ownership of the Appliance transfers to us if all charges remain unpaid 60 days after invoice date. We may sell or recycle the Appliance to recover costs. Surplus funds (if any) will be returned to you.
5. Warranty
5.1 New parts installed by us carry a 12-month parts-and-labour warranty (fair wear & tear excepted).
5.2 Used parts are supplied as-is with no warranty.
5.3 Our warranty is void if:
• The Appliance is misused, modified, or repaired by anyone else; or
• The fault is unrelated to our work.
6. Liability (All-Care / No-Responsibility)
6.1 Modern appliances are often designed with limited serviceability. Despite all reasonable care, disassembly, solder reflow, plastic clips, ribbon cables, or aged components may fail during repair. You acknowledge this risk and agree that:
a) We are not liable to replace an Appliance that is damaged or rendered uneconomic to repair due to latent defects, brittle materials, corrosion, or manufacturer design; and
b) Our total liability, whether in contract, tort (including negligence), or otherwise, is capped at the invoiced cost of our services for the specific Appliance.
6.2 We are not liable for indirect, consequential, or special loss (e.g., lost data, business interruption).
6.3 Nothing in these Terms excludes liability we cannot lawfully exclude under the Consumer Guarantees Act 1993 (CGA), Fair Trading Act 1986 (FTA), or for personal injury caused by our negligence.
Business customers: Where you are “in trade” and acquiring services for business purposes, you and we contract out of the CGA to the extent permitted by s43 CGA.
7. Consumer Rights & Returns
7.1 If you are a consumer under the CGA, you have statutory rights that cannot be excluded. If our service fails to meet a statutory guarantee, we will remedy it as required by law.
7.2 Return freight is at your cost unless we are obliged to pay it under the CGA.
8. Appointment Confirmation
We will confirm your booking (time & address) the business day prior. Missed appointments may incur the standard call-out fee.
9. Data, Settings & Accessories
Please back up data and remove SIMs, SD cards, or personal accessories. We are not responsible for loss of data or removable media.
10. Force Majeure
We are not liable for delay or failure caused by events beyond our reasonable control (e.g., natural disasters, supply-chain shortages).
11. Dispute Resolution
If a dispute arises, both parties will first attempt good-faith negotiation. Failing agreement, either party may refer the matter to mediation or the Disputes Tribunal (for claims up to the Tribunal’s monetary limit).
12. Governing Law
These Terms are governed by the laws of New Zealand. Venue is the Christchurch District Court (or the Disputes Tribunal, where applicable).
13. Entire Agreement
These Terms, together with any written quote or work authorisation, form the entire agreement and prevail over your purchase orders or other documents.
By booking a service or delivering an Appliance to Test Tag and Repair, you confirm that you have read, understood, and accepted these Terms of Trade.
